2. General
These general business relationships apply to all our deliveries of goods and - analogously - to the provision of services by us in distance selling, even if these

If a product cannot be delivered within four weeks for reasons for which we are not responsible, we reserve the right to withdraw from the contract.


3. Prices and Payment
The prices given are daily prices and the sales price given on the day of the order applies. Unless otherwise stated, all prices are gross prices including statutory sales tax. The costs incurred by shipping and the cash on delivery fee are not included in the prices (see next point). In the event of obvious errors, BöHM.s deko & wohnambiente reserves the right to calculate the correct price after consultation. Payment is made by cash on delivery or cash in advance.


4.Shipping costs

The cash on delivery fee is already specified when ordering and is also listed in the shipping costs table. Unless expressly stated otherwise, the transport insurance will be taken out.

If the shipment is damaged or lost, all costs will be borne by the transport insurance and we will take over the handling with the insurance company. The report must already be sent directly to the parcel service upon acceptance. Therefore, check the package for integrity immediately upon acceptance.

 

5.Terms of Delivery
The goods will be sent to the delivery address you specified using a parcel service.
We are entitled to carry out partial deliveries to a reasonable extent.

 

6. Refusal to Accept
If we refuse to accept our delivery without prior written cancellation of the order, we will charge a share of the costs of EUR 22 in Austria and EUR 36 outside of Austria.
In addition, we unfortunately have to calculate the shipping costs incurred if this is not our fault

7. Retention of title
The goods you have ordered remain our property until full payment has been made. Before our claim has been paid in full, you are prohibited from pledging the goods, assigning them as security or granting other people other rights to them.

8. Right of Withdrawal
If you are a consumer within the meaning of the Consumer Protection Act, you can withdraw from a concluded contract (or a contractual declaration made) by written declaration (by e- e-mail, fax or post). It is sufficient if the declaration of withdrawal is sent within the period. The condition for this is that the goods are unopened, unused and in new - resalable condition and are returned in the original packaging and an additional, stable outer packaging. The shipping costs are borne by the customer. For items that are affected by signs of use or whose packaging is damaged, we will charge an appropriate fee for the reduction in value. Please also note that we can only refund the current sales price as long as there is no reason for a conversion according to the KschG.

 

9. Returns
Please fill out the RMA form before you send the goods to us. 
You will then receive an RMA number from us, which you must note on the package. Please note,
that we can only accept deliveries if they come with an RMA number, RMA accompanying letter

10. Warranty and Liability:
In the case of justified complaints about defects within the statutory warranty period and if the statutory requirements are met, we can choose between free improvement or supplementation of the missing item or replacement delivery within a reasonable period of time. Compensation for consequential damage, other direct damage and loss or loss of profit from defective, omitted or late delivery is excluded. Liability for personal injury and any claims for compensation under the Product Liability Act are not limited by the above provisions. Any defects that occur are to be reported as soon as possible upon delivery or after they become visible, without there being any adverse legal consequences for the customer, who is a consumer within the meaning of the KSchG. If the customer is an entrepreneur or consumer in the sense of 
of the KSchG, he must check the delivered goods or the service rendered for completeness, correctness and other defects immediately upon receipt. Any defects must be reported in writing immediately, otherwise all claims to which he is entitled from defects that can be identified during a proper inspection are lost. 11. Guarantee
BöHM.s decoration & wohnambiente grants the warranty periods guaranteed by the manufacturer on all products. Unless otherwise stated, all warranties are BRING-IN warranties. The provisions of the manufacturer apply to the processing of the guarantee. In these cases (manufacturer's warranty), warranty processing may have to be carried out directly between the manufacturer and the customer and not by us. If the warranty is processed by us (if there is no manufacturer warranty), the components complained about will be sent to the manufacturer and replaced by the manufacturer after the case has been processed.

13. Data Security
We assume no liability for errors in the transmission of the data.

 

14. Jurisdiction
The place of jurisdiction for consumers is based on the statutory provisions. Otherwise, the competent court in Kitzbühel shall be the place of jurisdiction. Austrian law applies, unless regulations for the protection of consumers speak against it.

 

15. Severability Clause
Should individual provisions of the contract, including these regulations, be wholly or partially invalid, or should the contract contain a gap, the validity of the remaining provisions or parts of such provisions shall remain unaffected. Instead of the invalid or missing provisions, the respective regulations apply. A waiver of these rights cannot be derived from the fact that we do not exercise any or all of the rights arising to us. In the event of contractual disagreements, we accept the Internet ombudsman as an out-of-court arbitration board, but without renouncing the ordinary legal process.
